In the Matter of the Companies’ Creditors Arrangement Act and in the Matter of a Plan of Compromise of Nortel Networks Corporation et al

The Plaintiff was the former President and Chief Executive Officer of Nortel Networks Corporation.

Nortel was one of the largest telecommunications companies in the world until it filed for bankruptcy protection (pursuant to the CCAA) in January 2009. The CEO had been dismissed earlier, in April 2004; the company relied on allegations of misconduct alleged based on a review of certain aspects of Nortel’s financial reporting.

In January 2005, Nortel commenced a lawsuit against the CEO for repayment of bonuses that had been awarded to him prior to his termination. The CEO in turn sued Nortel for defamation and wrongful dismissal as well as other matters arising from the termination of his employment. The CEO sought payment of certain bonuses and other amounts.

We were retained by counsel to the CEO to calculate the value of the various amounts claimed.

The court award reflected the payment of bonuses and other amounts to the CEO calculated from our evidence.
